Byron Eerebout is given one last chance to cut a deal with the prosecuter's office by giving the location of Cher Elder's body along with telling everything he knew about night she died and what Tom Luther did to her. If he had not taken that last chance(he had been given several chances to tell what he knew before this but had failed to be honest and tell what he knew including giving up the location of Cher's body) he would go back to his jail cell immediately where he would wait for his trial on separate charges where he would face a 28 year sentence.
Byron's lawyer(Leslie Hansen) was hoping for her client's sake that he would get the deal from the District Attorney because she knew there was so much evidence that he would almost certainly be convicted on the charges he was facing. Byron took his last chance at the deal...Detective Scott Richardson made it clear it was his last chance.
On Page 342,the book states, "Even so, Babe(Byron's mom) interfered again. She thought Byron could get a better deal. Fed up, Richardson decided to hell with Eerebout and made arrangements to have him shipped back to the penitentiary. Let him explain where he'd been and who he'd been talking to. He'd find Cher on his own, arrest Luther for murder and Eerebout for being an accomplice. But when Leslie Hansen(Byron Eerebout's lawyer) heard that her client was about to be returned to Canon City, she called Richardson in a panic. "Is the deal still good?" she asked meekly."
Two days later, Byron took Richardson to the exact location of the body and gave a formal statement of everything he knew about the night Cher died and every detail that he knew about what Tom Luther had done that night and ever since.
